Welcome to Pilecast.net, operated by Pile Cast Fly Fishing LLC, doing business as Pile Cast Fly Fishing (“Pile Cast,” “we,” “us,” or “our”).
These Terms and Conditions (“Terms”) govern your use of Pilecast.net, purchases of merchandise through our website, and the booking and participation in guided fishing trips and other services offered by Pile Cast.
By accessing this website, purchasing merchandise, booking a guided trip, or otherwise using our services, you agree to these Terms.
If you do not agree with these Terms, please do not use the website, purchase products, or book our services.
1. Website Use
Pilecast.net provides information relating to fly fishing, fishing, outdoor recreation, merchandise, guided fishing services, and related subjects.
You agree to use this website only for lawful purposes and in a manner that does not interfere with the operation or security of the website or the rights of others.
We may modify, suspend, or discontinue any portion of the website at any time without notice.
2. Merchandise and Retail Sales
Pile Cast may sell shirts, hats, stickers, apparel, accessories, fishing-related products, promotional items, and other merchandise through Pilecast.net.
Product Descriptions
We make reasonable efforts to accurately display and describe our products. However, actual colors, dimensions, appearance, materials, or other characteristics may vary slightly from photographs or descriptions displayed on the website.
We do not guarantee that all product descriptions, photographs, prices, or other information are completely free from errors.
Availability
All merchandise is subject to availability.
We reserve the right to:
- Limit quantities;
- Discontinue products;
- Refuse or cancel orders;
- Correct pricing or product-description errors; and
- Change products or prices at any time.
If we cancel an order after payment has been received, we will refund the amount charged for the canceled item or order.
3. Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable sales taxes, shipping charges, processing fees, or other charges may be added during checkout where required.
Payment must be made using one of the payment methods offered through the website.
By submitting payment information, you represent that you are authorized to use the payment method provided.
We reserve the right to refuse or cancel transactions that we reasonably believe may be fraudulent, unauthorized, or otherwise improper.
4. Shipping
We will make reasonable efforts to ship merchandise within the time stated on the website or during checkout.
Shipping and delivery dates are estimates unless expressly stated otherwise.
Pile Cast is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, severe weather, natural disasters, labor disruptions, incorrect customer addresses, or similar events.
If an order cannot be shipped within the time originally represented, we will handle the delay, cancellation, and any required refund in accordance with applicable law.
Customers are responsible for providing an accurate and complete shipping address.
5. Returns, Exchanges, and Refunds
Unless a different return policy is stated on the product page or during checkout, unused and unworn merchandise may be returned within 30 days of delivery.
Returned merchandise must be in its original condition.
The following may not be eligible for return unless defective or required by law:
- Used or worn merchandise;
- Damaged merchandise caused by the customer;
- Customized or personalized items;
- Clearance or items specifically identified as final sale; and
- Stickers or similar low-value items that have been used, applied, or removed from their original packaging.
Original shipping charges are generally non-refundable unless the return results from an error by Pile Cast or the merchandise arrived defective or damaged.
Customers may be responsible for return shipping costs unless otherwise stated.
Please contact us before returning merchandise so that we can provide return instructions.
6. Guided Fishing Services
Pile Cast offers guided fishing trips and related outdoor services.
Guided fishing inherently involves outdoor conditions that can change rapidly and may include travel by boat, wading, walking over uneven terrain, exposure to water, weather, wildlife, fishing equipment, hooks, sharp objects, insects, vegetation, slippery surfaces, currents, and other natural and man-made hazards.
By booking a guided fishing trip, you acknowledge that outdoor recreation involves risks that cannot be completely eliminated.
7. Fishing Licenses and Legal Compliance
Each participant is responsible for obtaining and carrying any fishing license, stamp, permit, or other authorization required by applicable law.
Participants are responsible for complying with all applicable fishing laws and regulations, including regulations concerning seasons, locations, methods, equipment, size limits, and possession limits.
Pile Cast may refuse to allow a participant to fish if the participant does not possess a legally required license or refuses to comply with applicable fishing regulations.
No refund is required when a participant is unable to participate because the participant failed to obtain a required license or permit.
8. Catch and Release
Unless specifically stated otherwise for a particular trip, Pile Cast guided fishing trips are conducted on a catch, photograph, and release basis.
Participants agree to follow the guide’s instructions regarding the handling, photographing, and release of fish.
Conservation of the fishery and the responsible treatment of fish are important parts of the Pile Cast guided fishing experience.
9. No Guarantee of Fish or Fishing Conditions
Fishing is affected by weather, water temperature, water levels, water clarity, seasonal patterns, fish behavior, fishing pressure, and numerous other conditions outside our control.
Pile Cast does not guarantee that customers will catch fish, catch a particular species, catch a particular number of fish, or catch fish of any particular size.
A slow fishing day or failure to catch fish does not entitle a customer to a refund.
10. Weather, Water Conditions, and Safety
Safety decisions are made by the guide.
Pile Cast reserves the right to delay, relocate, modify, shorten, reschedule, or cancel a trip because of:
- Severe or dangerous weather;
- Lightning;
- Flooding;
- Unsafe water levels or currents;
- Dangerous boating conditions;
- Extreme temperatures;
- Road or access conditions;
- Equipment problems;
- Government restrictions;
- Guide illness or emergency; or
- Any other condition that the guide reasonably believes could affect participant safety.
The guide’s decision regarding whether conditions are safe is final.
If Pile Cast cancels a trip before it begins because conditions are unsafe or because Pile Cast cannot provide the scheduled service, the customer will generally be offered the opportunity to reschedule or receive a refund of the guide-service amount paid.
Pile Cast is not responsible for a customer’s travel expenses, lodging, meals, lost wages, transportation expenses, or other incidental costs associated with a canceled or rescheduled trip.
11. Customer Cancellations and No-Shows
Any deposit, cancellation, refund, or rescheduling requirements disclosed during booking, on the guided-trip page, or in the booking confirmation are incorporated into these Terms.
Customers are encouraged to notify Pile Cast as soon as possible if they need to cancel or reschedule.
Customers who fail to appear for a scheduled trip without prior notice may forfeit payments or deposits made for that trip.
Weather cancellations are determined by Pile Cast. A customer’s personal decision not to participate because of weather that the guide considers safe does not automatically constitute a weather cancellation by Pile Cast.
12. Participant Responsibilities
Participants must follow reasonable instructions provided by the guide.
Participants must inform the guide before the trip of any circumstances that may materially affect their ability to safely participate in the planned activity.
Participants are responsible for:
- Wearing appropriate clothing and footwear;
- Bringing any personal medications or medical supplies they may require;
- Using appropriate sun protection;
- Staying hydrated;
- Following boating and water-safety instructions;
- Properly using fishing equipment; and
- Acting in a responsible manner around other participants and members of the public.
Pile Cast may terminate a participant’s trip without refund if the participant engages in dangerous, threatening, abusive, reckless, illegal, or disruptive conduct.
13. Alcohol and Drugs
Participants may not participate while impaired by illegal drugs, excessive alcohol consumption, or any substance that makes participation unsafe.
Pile Cast may refuse or discontinue service to any participant whom the guide reasonably believes is impaired or unable to safely participate.
A trip terminated for this reason may be treated as a customer cancellation and may not qualify for a refund.
14. Minors
Participants under 18 years of age must have the permission of a parent or legal guardian and must be accompanied as required by Pile Cast or applicable law.
A parent or legal guardian may be required to execute additional participation, acknowledgment-of-risk, and liability documents on behalf of a minor before the minor may participate.
15. Assumption of Risk
By voluntarily participating in a guided fishing trip or other outdoor activity offered by Pile Cast, you acknowledge that fishing and outdoor recreation involve inherent and other risks, including the possibility of property damage, personal injury, illness, permanent disability, drowning, or death.
Risks may include, without limitation:
- Slips, trips, and falls;
- Wading or falling into water;
- Strong currents and changing water levels;
- Boating accidents;
- Drowning;
- Fishing hooks, knives, tools, and other equipment;
- Falling trees or branches;
- Rocks, logs, and submerged objects;
- Wildlife, insects, and plants;
- Exposure to heat, cold, rain, sun, wind, or lightning;
- Transportation to or from fishing locations;
- Actions of other participants or members of the public; and
- Remote locations where emergency assistance may be delayed.
You voluntarily assume the ordinary and inherent risks associated with participating in these activities to the fullest extent permitted by applicable law.
16. Separate Participant Waiver
Pile Cast may require customers and participants to sign a separate Acknowledgment of Risk, Release of Liability, and Waiver Agreement before participating in a guided fishing trip.
A participant who refuses to execute a required waiver may be prohibited from participating in the trip.
These Terms do not replace any separately executed waiver or participation agreement.
17. Equipment
Pile Cast may provide rods, reels, tackle, flies, personal flotation devices, or other equipment as part of certain guided services.
Customers agree to use provided equipment responsibly and according to the guide’s instructions.
Customers may be responsible for the reasonable cost of equipment that is intentionally damaged, recklessly damaged, or not returned.
Normal wear, ordinary breakage associated with fishing, and equipment failure are not considered customer damage.
18. Personal Property
Participants are responsible for their own personal property.
To the fullest extent permitted by law, Pile Cast is not responsible for lost, stolen, damaged, dropped, or water-damaged phones, cameras, fishing equipment, clothing, eyewear, keys, wallets, or other personal belongings.
19. Photography and Media
Pile Cast may take photographs or video during guided trips.
We will obtain appropriate permission before using identifiable customer photographs or video for commercial advertising or promotional purposes when required.
Customers who do not wish to appear in photographs or promotional materials should notify the guide.
20. Gift Certificates and Promotional Offers
Gift certificates, discount codes, promotions, giveaways, and special offers may be subject to additional terms disclosed when the offer is made.
Promotional offers may not be combined unless expressly permitted.
Nothing in these Terms is intended to limit rights regarding gift certificates or promotional items that cannot legally be waived.
21. Website Content and Intellectual Property
Unless otherwise stated, the photographs, articles, graphics, logos, videos, designs, written content, and other original materials appearing on Pilecast.net are owned by or licensed to Pile Cast.
Content may not be copied, reproduced, republished, sold, distributed, or commercially exploited without permission, except as permitted by applicable copyright or other law.
“Pile Cast,” “Pile Cast Fly Fishing,” associated logos, and other branding may constitute trademarks or trade names of their respective owners.
22. Third-Party Websites and Services
Pilecast.net may contain links to websites, social media platforms, payment processors, booking services, manufacturers, fishing resources, or other third parties.
Pile Cast does not control and is not responsible for the content, security, privacy practices, availability, or policies of third-party websites or services.
Use of third-party services may be governed by separate terms and privacy policies.
23. Website Disclaimer
Information provided on Pilecast.net, including fishing information, articles, trip reports, product information, recommendations, and educational material, is provided for general informational purposes.
Fishing regulations, water conditions, access rules, and other information can change.
Customers and website visitors remain responsible for confirming current laws, regulations, access restrictions, and conditions before fishing or participating in outdoor activities.
24. Disclaimer of Warranties
To the fullest extent permitted by law, the website, website content, merchandise, and services are provided on an “as available” basis.
Pile Cast disclaims warranties that may legally be disclaimed, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
25. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PILE CAST AND ITS OWNERS, MEMBERS, EMPLOYEES, GUIDES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF THIS WEBSITE, PURCHASE OF MERCHANDISE, OR PARTICIPATION IN SERVICES.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.
The enforceability of any limitation of liability will be determined under applicable law.
26. Indemnification
To the extent permitted by law, you agree to be responsible for losses, damages, claims, or expenses arising from your intentional misconduct, unlawful conduct, or material violation of these Terms.
This provision does not require a consumer to indemnify Pile Cast for liability that cannot lawfully be transferred to the consumer.
27. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except to the extent another jurisdiction’s non-waivable consumer protection laws apply.
Any legal proceeding relating to these Terms will be brought in an appropriate state or federal court having jurisdiction in the Indiana county where Pile Cast maintains its principal place of business, unless applicable law requires otherwise.
28. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
29. No Waiver
Failure by Pile Cast to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
30. Changes to These Terms
We may update these Terms periodically.
The revised Terms will be posted on Pilecast.net with an updated effective date.
Changes will apply prospectively unless applicable law permits otherwise.
For purchases or guided trips already booked, the terms in effect at the time of the transaction will generally govern that transaction unless the customer agrees to a modification.
31. Entire Agreement
These Terms, together with any applicable booking confirmation, cancellation policy, return policy, privacy policy, participant waiver, and other terms expressly incorporated into them, constitute the agreement between you and Pile Cast concerning the applicable website use, purchase, or service.
If a separately signed guided-trip agreement or liability waiver conflicts with these Terms regarding participation in a guided activity, the separately signed agreement will control to the extent permitted by law.
